لقد تباين موقف المشرع الجزائري بشأن التحكيم كآلية لتسوية المنازعات المتعلقة بالصفقات العمومية حيث أنه منذ الاستقلال كان المبدأ العام يقضي بأن كل منازعات الصفقات العمومية تسوى عن طريق القضاء لكن هذا الموقف سرعان ما أخذ في التراجع مع مرور الوقت شيئا فشيئا إلى أن تم التخلي عن هذا الحظر بمقتضى القانون رقم 08-09 المتضمن قانون الإجراءات المدنية و الإدارية
Abstract EN
The position of the Algerian lawmaker on arbitration as a mechanism for resolving disputes related to procurement contract has varied.
Since independence, the general principle has been that all disputes of public procurement are settled by the judiciary, but this attitude gradually subsided until the abandon of this restriction in accordance with Law No.
08-09 of the Code of Civil and Administrative Procedure.
