القصاص في النفس عقوبة تقررها الشريعة الإسلامية على جرائم القتل العمد، بشروط متعددة و دقيقة.
و القصاص في النفس معناه معاقبة الجاني بمثل فعله، أي قتل القاتل عمدا.
وقد أعطت الشريعة الإسلامية حق المطالبة بالقصاص في النفس لأولياء الدم، كما أعطتهم أيضا حق التنازل عنه، و هذا بالعفو عن الجاني، إما مجانا، أو بمقابل مالي، و حثتهم عليه.
أصبح القصاص في الآونة الأخيرة، مطلبا شعبيا عقب كل جريمة قتل عمد تقع في المجتمع، فجاء هذا المقال لتوضيح ماهية القصاص في النفس في الشريعة الإسلامية و بيان أحكامه.
: AL-QISAS punishment (the law of equality in punishment with crime)
Abstract EN
in case of murder, is a punishment prescribed by Islamic law, for intentionally homicide, on multiple and precise conditions.
AL-QISAS punishment means, punishing the perpetrator as he did to kill the victim intentionally.
The Islamic law, has given the family of victim the right to demand this punishment, and has given them the right to pardon the killer, either free of charge or financially.
AL-QISAS punishment, has recently become a popular demand, after every murder in the country.
This article came to clarify the nature of AL-QISAS punishment in Islamic law, and the statement of its dispositions.
