The new international order is characterized by characteristics that depend mainly on the economic capabilities controlled by the scientific and technological power, which is monopolized by a fast changing of the production method and competition.

These characteristics have shown new international means as well as the developed countries have created the World Trade Organization as an ideal means to achieve their objectives in order to achieve a legitimate competition through the liberalization of international trade, and therefore if the elements of production moved freely and without restrictions, a fair competition would be achieved between economic projects.

However, accession to the World Trade Organization (WTO) and the ratification of its conventions in which the TRIPS Agreement is considered one of the most important of these agreements where the subscribing countries are obliged to amend their national legislation and regulations in accordance with the degree and level of protection set by the TRIPS Agreement and because the provisions of this Convention are not self-executing, thus the member States must review and amend their national laws in accordance with the provisions of the Convention.
