لقد أدت تدابير الوقاية من فيروس كورونا كالحجر المنزلي و المنع من التنقل و غلق الحدود و الأسواق و المنشآت.

إلى طرح التساؤل عن مدى تأثير هذه التدابير على تنفيذ الالتزامات التعاقدية و عن الحلول القانونية و القضائية التي تؤطر العلاقة بين المتعاقدين عند تغير ظروف تنفيذ العقد عن ظروف إبرامه في العقود المدنية و العقود الإدارية و قد خلص البحث إلى نتيجة مفادها أن تأثير تدابير الوقاية قد يستدعي تطبيق نظريتي الظروف الطارئة أو القوة القاهرة بالنسبة لمختلف العقود و امكانية تطبيق نظرية عمل الأمير أيضا بالنسبة للعقود الإدارية.
مع دراسة شروط تطبيق هذه النظريات خاصة "شرط عمومية الحدث الخارجي" و "شرط عدم توقع الحدث" و ما تثيره من صعوبات عند إسقاطها على تدابير مواجهة جائحة كورونا
Abstract EN
Covid19 prevention measures, such as national quarantine, movement prevention, border, market and facility closures…, have raised, in practice, the question of the impact of these measures on the performance of contractual obligations, and of legal and judicial solutions relating to the relationship between the contractors once the terms of the contract are modified, both civil and administrative contracts.
In the face of these rapid changes, it has been concluded that the impact of these measures requires the full application of the theory of unforeseeability, or even force majeure, for all these contracts, and the possibility of applying the prince's effect theory also for administrative contracts, taking into account the related conditions, particularly «a general condition for the external event» and «a condition of not anticipating the event», but without forgetting the difficulties that arise from their application in the face of the coronavirus pandemic.

Les mesures prises de prévention du coronavirus, telles que la quarantaine nationale, la prévention des mouvements, la fermeture des frontières, des marchés et des entités…, ont soulevé, en pratique, la question de l'impact de ces mesures sur l'exécution des obligations contractuelles, et des solutions juridiques et judiciaires se rapportant à la relation entre les contractants du fait de la modification des stipulations du contrat et ce, en matière aussi bien des contrats civils qu'administratifs.
Face à ces prompts changements, on est arrivé à conclure que l'impact desdites mesures requièrent pleinement l'application de la théorie de l'imprévision, voire de la force majeure pour l'ensemble de ces contrats, ainsi que la possibilité d'appliquer la théorie du fait de prince pour les contrats administratifs, compte tenu des conditions y afférentes, particulièrement «la condition de généralité de l'évènement externe» et «la condition de non-anticipation de l'évènement», mais sans omettre les difficultés qui surgissent quant à leur application face à la pandémie du coronavirus.
