This research paper deals with the scope of the Public order in family subjects, the authority empowered to determine its cases, what is eternal constant that is not subject to change or amendment, from any party, and what is subject to change and development according to the development of the family and society, according to the Algerian legal system

Cette étude traite la place de l'ordre public en matière familiale, précisant par là l'autorité habilitée à déterminer ses cas, lesquels peuvent être, d’une part, une constante éternelle qui ne saurait nullement être modifiée, et d’autre part, celles dont la modification est acceptable, compte tenu de l'évolution familiale, voire de la société, selon l’ordre juridique algérien.
