من خصوصية السلطات الإدارية المستقلة الجمع بين عدة اختصاصات تسمح لها من تحقيق مهمة الضبط التي أنشئت من اجلها حيث أنها لا تكتفي بحل النزاعات في المجالات التي تضبطها بل تتولى قبل ذلك تحديد القواعد التنظيمية التي تحقق التوازن الاقتصادي و بعدها تنظيم الرقابة الفعالة التي من خلالها تضمن احترام الأعوان الاقتصاديين لما تسنه من أحكام مما يعني حوكمة المؤسسات الاقتصادية حوكمة حقيقية.
وقد لا تتمتع جميع السلطات الإدارية المستقلة بخاصية الجمع بين جميع الاختصاصات حيث تختص بالبعض دون الآخر إضافة إلى الإشكالات التي تنتج عن تلك الاختصاصات سيما منها دستورية الاختصاص التنظيمي و ضرورة توفير الضمانات الكفيلة بتوقيع جزاء عادل
Abstract EN
Among the particularities of independent administrative authorities is the right to combine several powers enabling it to carry out the control task entrusted to it, because it does not only resolve conflicts within its competence, but above all they determine in advance the regulatory provisions granting an economic balance, and then an effective control guaranteeing respect for economic operators.
As a result, the governance of economic enterprises is real governance.
However, not all independent administrative authorities may have the right to group all competences, since they possess some without others, in addition to the difficulties arising from them, in particular the constitutionality of organizational competence and the need to provide guarantees of a fair sanction.

Parmi les particularités des autorités administra-tives indépendantes, le droit de combiner plusieurs compétences lui permettant d'accomplir la tâche de contrôle qui lui a été confiée, car elle ne résout pas uniquement les conflits rentrant dans sa compétence, mais avant tout elles déterminent au préalable les dispositions réglementaires concédant un équilibre économique, puis un contrôle efficace garantissant le respect des agents économiques.
Il en résulte que la gouvernance des entreprises économiques est une gouvernance réelle.
Or, il se peut que toutes les autorités administra-tives indépendantes ne disposent pas du droit de regrouper toutes les compétences, puisqu'elles possèdent certaines sans d'autres, en plus des dif-ficultés qui en découlent, notamment de la consti-tutionnalité de la compétence organisationnelle et la nécessité de fournir les garanties d'une sanction équitable.
