Scientific development has revolutionized the field of forensic evidence, thus has been reflected in DNA fingerprinting which is no longer limited to hand fingerprints, but transcends to iris scan, ear recognition (outer ear), sound (voice) recognition, and others.

Undoubtedly, DNA fingerprinting has become one of the most important scientific evidence leading to the recognition of persons' identity and criminals'.

In fact, by issuing Law N16/03 on the use of DNA in judicial proceedings and identification of persons, the Algerian legislator has moved forward by coping with scientific developments through allowing the judicial power to benefit from that technique in terms of dealing with any crime.

Considering the importance of using DNA as a scientific evidence in forensics, the legislator has sought, through regulations of penal legitimacy, to protect human rights and personal freedom, and ensure a proper balance between the interests of society and those of the individual.
