تلعب المبادئ العامة للقانون المذكورة في المادة 38 من النظام الأساسي لمحكمة العدل الدولية دورا هيكليا في بناء قواعد القانون الدولي العام حتى يتماشى و التسارع الكبير على مستوى العلاقات الدولية من جهة و سد العجز الذي كان يصادف المحاكم الدولية عند حل النزاعات الدولية من جهة أخرى و قد كشفت الاجتهادات القضائية للمحكمة الدائمة للعدل الدولية سابقا و محكمة العدل الدولية عن مجموعة من المبادئ التي نقلت من القوانين الداخلية إلى القانون الدولي العام و هذا حتى تتناسب قواعده مع الديناميكية السريعة لتوسعه على المستوى الأفقي لفروعه و بهذا فدرستنا تعالج فكرة تطور القانون الدولي بواسطة الاجتهادات القضائية الدولية
Abstract EN
The general principles of law mentioned in article 38 of the Statute of the ICJ.
play a structural role in the edification of the rules of public international law in order to be in phase with the strong acceleration of the level of international relations on the one hand, and to make up for the deficiten countered by international courts during the settlement of international disputes , on the other hand.
The jurisprudence of the old CPJI and of the CIJ revealed a set of principles, which flowed from Internal, laws to general international law and this so that its rules are consistent with the rapid dynamics of its expansion at the horizontal level of its branches.
With this, our study addresses the idea of the development of international law under international jurisprudence.

Les principes généraux du droit mentionnés à l'article 38 du Statut de la CIJ, jouent un rôle structurel dans l'édification des règles du droit international public.
Afin d'être en phase avec la forte accélération du niveau des relations internationales d'une part, Et de combler le déficit rencontré par les tribunaux internationaux lors du règlement des différends internationaux, d'autre part.
La jurisprudence de l'ancienne CPJI et de la CIJ a révélée un ensemble de principes qui découlaient des lois Internes au droit international général, et ceci afin que ses règles soient cohérentes avec la dynamique rapide de son expansion au niveau horizontal de ses branches.
Avec cela, notre étude aborde l'idée du développement du droit international en vertu de la jurisprudence international.
