لقد تبنى المشرع الجزائري عقوبة الإعدام منذ فجر الاستقلال على غرار العديد من الأنظمة القانونية الجزائية إلا أن الملاحظ هو أنه قد بالغ في اللجوء إلى هذه العقوبة وذلك بالنص عليها في عدد كبير جدا من الجرائم و هو ما يتناقض مع فلسفته في العقاب و المتمثلة في إصلاح المجرمين بدلا من الردع العام
Abstract EN
The death penalty in Algerian legislation ¨ the Algerian legislator has adopted the death penalty since the dawn of independence, along the lines of many criminal legal systems Hawever, what is noticeable is that he exaggerated the resort to this punishment, as stipulated in a very large number of crimes, which contradicts his philosophy of punishment that is to reform criminals instead of general deterrence

Le législateur algérien a adopté la peine de mort Depuis l’aube de l’indépendance , a l’instar de nombreux systèmes judiciaires pénaux Cependant , ce qui est notable , c’est qu’il a exagéré le recours a cette peine , comme le stipule un très grand nombre de crimes , ce qui contredit sa philosophie de punition qui est de réformer les criminels au lieu de la dissuasion générale
