يشهد العالم في الآونة الأخيرة تطورا تكنولوجيا هائلا في شتى مجالات الحياة نتيجة للاختراعات الحديثة التي يتم التوصل إلى تحقيقها في مختلف ميادين النشاط الإنساني فكان من الطبيعي أن تنعكس آثار هذا التطور على الجهود الدولية التي تناولت حماية براءة الاختراع باعتبارها قوام هذا التقدم و التي أثمرت عنها إبرام العديد من المعاهدات و الاتفاقيات الدولية.
غير أن وضع تنظيم شامل لبراءات الاختراع في وحدة متناسقة لم يتحقق إلا مع ظهور إتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية TRIPS حيث كان لها الدور الأكثر تأثيرا في هذا المجال بما أضفته من حماية متكاملة لبراءات الإختراع و الحقوق الناشئة عنها و لعل دورها المؤثر و الريادي في هذا المجال إنما يعود إلى ما أرسته هذه الاتفاقية من مبادئ و ما استحدثته من أحكام على نحو غيرت كثيرا من ملامح التنظيم الدولي فيما يتعلق بمجال الملكية الفكرية و الصناعية عامة و حماية براءات الاختراع في مجال الصناعات الدوائية و الصيدلانية على وجه الخصوص.
Abstract EN
The world has recently witnessed considerable technological development in various areas of life as a result of modern inventions made in various fields of human activity.
It was natural for the effects of this development to be reflected in international efforts that treated patent protection as the basis for this progress, which led to the conclusion of numerous international treaties and agreements .
However, the creation of a comprehensive patent regulation as a coherent unit was only achieved with the emergence of the Agreement on Trade-Related Aspects of Intellectual Property Rights (STRIPS), where the most influential role was in this area, with the integrated protection added in terms of patents and the rights deriving from them.
Its influential and pioneering role in this field is perhaps due to the principles established by this agreement and the provisions it introduced in a way that profoundly changed the characteristics of international regulation in the field of intellectual and industrial property in general, and patent protection in the field of pharmaceutical industries in particular.

Le monde assiste ces derniers temps à un développement technologique considérable dans divers domaines de la vie à la suite des inventions modernes réalisées dans divers domaines de l'activité humaine.
Il était naturel que les effets de cette évolution se reflètent dans les efforts internationaux qui ont traité la protection du brevet comme base de ce progrès, et qui ont abouti à la conclusion de nombreux traités et accords internationaux .
Cependant, la création d'une règlementation complète des brevets en une unité cohérente n'a été réalisée qu'avec l'émergence de l'Accord sur les aspects des droits de propriété intellectuelle qui touchent au commerce (STRIPS), là où le rôle le plus influent était dans ce domaine, avec la protection intégrée ajoutée en termes des brevets et des droits qui en découlent.
Son rôle influent et pionnier dans ce domaine est peut-être dû aux principes établis par cet accord et aux dispositions qu’il a introduites d’une manière qui a profondément modifié les caractéristiques de la réglementation internationale dans le domaine de la propriété intellectuelle et industrielle en général, et de la protection des brevets dans le domaine des industries pharmaceutiques en particulier.
