According to the principle mentioned in the title, parties to a dispute have the right to request a new judgment on the merits before a court of second degree so to rectify any errors committed on the first level, particularly if the dispute concerns constituting political parties or their political rights (voting and being a candidate…).

Legislation concerning the matter in the Maghreb states (Algeria, Tunisia and Morocco) are different.

This research study is intended to clarify the extent of the principle of double adjudication in the three mentioned countries theoretically and practically.
