يتناول هذا البحث تسليط الضوء عن دور المحاكم الجنائية الدولية من خلال تجربة القضاء الدولي الجنائي التي أنشئت من أجل معاقبة مرتكبي الانتهاكات الجسيمة للقانون الدولي الإنساني هذه الممارسة أسهمت في تطوير و إيجاد تعريف دقيق لمفهوم الجريمة الدولية عموما و إرساء النظام القانوني لجرائم الحرب في غياب مشرع دولي يتولى وضع تقنين جنائي دولي و التي تعد أقدم الجرائم الدولية و الأشد خطورة حيث أن الممارسة القضائية لهاته المحاكم أسهمت في إيجاد تعريف شامل و دقيق لجرائم الحرب كتشريع دولي جنائي قائم تم إقراره من خلال نص المادة (8) من النظام الأساسي للمحكمة الجنائية الدولية و إقرار مبدأ المسؤولية الجنائية الدولية للأفراد عن ارتكاب جرائم الحرب.

This paper examines the contribution of the statutes of international criminal tribunals through the experience of international criminal justice Established to punish the perpetrators of serious violations of international law, What are the international crimes, This practice has contributed to the development and creation of a precise definition of the concept of international crime in general, And the establishment of the legal regime of war crimes in the absence of an international legislator to establish international criminal law, What are the oldest and most serious international crimes, Since the judicial practice of these courts, Contributed to a complete and accurate definition of war crimes, Such as existing international criminal law Adopted by the text of Article 8 of the Statute of the International Criminal Court.
