Abstract EN

The Algerian constitutional founder entrusted the constitutional council with the task of controlling the constitutionality of laws, under first constitution of the Algerian republic in 1963, and assigned him the mission of determining the constitutionality of laws and legislative orders.

Secondly, the powers of this council have grown under successive amendments until the last amendment in 2016, but it should be noted that these recent amendments were of paramount importance and affected the composition of the council.

And the rate of representation of each authority, have added special conditions for being a member of the council.

In addition, the constitutional founder has expanded the area of notification to individuals which is considered a significant increase in the control of the constitutionality of laws including that the constitutional founder has imposed the decisions and views of the constitutional council rigarding the authorities.

And individuals on an aqual basis.

There is no doubt that the abtion of the above would increase the value of the work of the constitutional council and archive what was established for it, which is to ensure effective control to ensure respect for the principle of the supremacy of the constitution.

Le fondateur constitutionnel algérien a confié au conseil constitutionnel la mission du contrôle de la constitutionnalité des lois, en vertu de la première constitution de la République algérienne en 1963, et lui a attribué la mission de déterminer la constitutionnalité des lois et des ordonnances législatives.

Ensuite, les compétences de ce Conseil ont pris d’ampleur en vertu des amendements qu’il a successivement subis jusqu'à la dernière modification en 2016, mais il est à noter que ces modifications récentes étaient primordiales, elles ont touché la composition du Conseil et le taux de représentation de chaque autorité, ont ajouté des conditions spéciales pour être membre au Conseil.

De plus, le fondateur constitutionnel a élargi le domaine de notification aux particuliers ce qui est considéré un essor notable en matière du contrôle de la constitutionalité des lois notamment que le fondateur constitutionnel a imposé les décisions et les points de vue du Conseil constitutionnel concernant les autorités et les individus à titre égal.

Il ne fait aucun doute que l'adoption de ce qui précède augmenterait la valeur du travail du Conseil constitutionnel et atteindrait ce qui était établi pour cela, ce qui consiste à assurer un contrôle efficace pour assurer le respect du principe de la suprématie de la Constitution.
