Abstract EN

The Evolution of private security companies in Iraq is a new phenomena in terms of legal literature as it traces back only to the time of CPA (Coalition Provisional Authority) the head of which Paul Bremer issued an order that sanctioned the constitution of such a kind of Companies.

It takes time for such companies to develop and get frequent in the public sphere life .The issuance of a specific law for the regulation of the works of such companies is the first step to recognize the works of those companies, away from the debate whether or not to allow the constitution of such companies.

This trend specifically was the way the Iraqi legislature acted on the background of the needs and necessity of partnering such companies in the public life through the security facility.

There are pressing needs for the regulation of the work of the above mentioned companies.

So the problem is a two-edged one or a double faceted problem, once there are necessities for the adoption of the work of such companies.

While on the other side we are required to observe some fundamental restrictions that are to be imposed on their work.

Thus we can come to the conclusion that the regulation of such companies and their work was well done by the Iraqi legislature.

This study focuses on the evolution, work, set up and all the legal mechanisms associated with the companies at odd.

The importance of the current topic lies in the fact it is a new event in the Iraqi legal system, so need to explore the different sides of it so as to evaluate the plus and minus of the fore-mentioned regulation.

Contextually the researchers opted to conduct a comparative –analytical method in this research paper, and mainly we compared Iraqi law to its equivalent of United Arab Emirates pertinent law.

This, in our view , was the best way to make a comparison that can yield useful outcomes that can serve the later amendment or improvements of the Iraqi laws applicable on the works of the private security companies.
