from the great importance of this subject through hits attachment to the powers of the Presidents of the Republic with regard to the declaration of the state of emergency on the one hand, and its connection with the rights and liberties of individuals guaranteed by the international charters and the provisions of the constitution which prohibit all practices that limit or touch them, but the non consideration of this in exceptional circumstances and especially the case of emergency in which the executive power gives itself the power to take all measures and procedures, even if this is to the detriment of other powers under the pretext of preserving and glorifying the general order against the rights and liberties of individuals, especially in the ence of control obligatory legal systems which provide real protection, as some similar legislations has done, puts them in danger and makes them an object of violation, so it is necessity to review this case and to put effective constraints on achieving the desired object to protecting liberties and achieving a balance between them and the power.

à partir de la grande importance que porte ce sujet à travers son attachement aux pouvoirs du présidents de la république en ce qui concerne la déclaration de l'état d'urgence d'une part, et par sa liaison avec les droits et libertés des individus garantis par les chartes internationales et les dispositions de la constitution qui interdisent toutes les pratiques qui les limitent ou les touches d'autre part, mais la non prise en considération de cela dans des conditions exceptionnelles et surtout au casd'urgence dans lequel le pouvoir exécutif se donne le pouvoir discrétionnaire à prendre toutes les mesures et procédures même si cela est au détriment des autres pouvoirs sous prétexte de préserver et de glorifier l'ordre général à l'encontre des droits et libertés des individus et spécialement en l'ence des contrôles légales obligatoires qui en assurent une vraie protection, comme ont fait quelques législations semblables, les mets en danger et les rend un objet de violation, ce qui pousse à la nécessité de revoir cette affaire et de mettre des contraintes efficaces à réaliser l'objectif voulu par la protection des libertés et la concrétisation de l'équilibre entre elles et le pouvoir.
