The Council of State has an important jurisdiction in the field of competition, since the legislator by virtue of the ordinance 03-03 related to the competition subjected the persons of public law to competition law, this enables him to identify the problems of the application of competition law as well as the various shortcomings and gaps when he was dismissed from the administrative dispute for competition.

On the other hand, the Council of State was given consultative jurisdiction in bills and draft orders, which allows him to contribute to the development of effective legal texts if the project concerns competition.
