The phenomenon of mixed marriage is not new to the international community, but it was modestly, at least for the Algerian society, which was among the peoples who preserved norms passed down through the generations.

This phenomenon has arisen and has become a target for young people, especially with the proliferation of illegal immigration and the association of Algerian youth with foreigners in order to settle their status towards the countries in which they are present, and because mixed marriage has risks to the cohesion of society and would disturb the integrity of the social fabric as a result of mixing with foreign strains, it was not The international community must put in place controls and provisions to regulate this type of marriage, especially in the event of disputes and conflicts arising between the two parties subject to different laws.

This makes this relationship subject to international law within the framework of concluding international agreements to regulate these relations and the consequences thereof, and the necessity of respecting these agreements at the level of the internal legislation of the state's parties on the basis of their obligation.

We have tried, through this study, to question the extent to which legal texts and international agreements are compatible in controlling mixed marriage and its provisions, by using the method of analysis of the legal text and some of the agreements concluded to answer this through two main axes.
