The contract is that agreement that the law required for its establishment a set of basic pillars through which it guarantees the validity of the contract on the one hand and to preserve the interest of the contracting parties on the other hand.

However, the latter may tire out some of its conditions or elements, which exposes it to relative nullity or olute nullity with the possibility of correcting the contract or converting it to another contract if the foundations of the latter are available, and this is what was approved and taken by the Algerian legislator.
