One of the most important rights created for the wife as a result of the marriage contract is her right to housing, which is essential for family stability and the sustanability of marriage.

In this way the epouses find comfort, and tranqulity.

This home must have basic conditions to be a legitimate home that guarantees the wife her independence and keeps each epouse their secrets.

However The Algerian legislature did not mention these conditions, which led to a Judicial intervention to determine them on the basis of Islamic jurisprudence
