Abstract EN

The mixed composition of the criminal court shows its popular nature.

It includes, in addition to the judges practicing the judiciary profession, the jury that is chosen from the general public, and who participate fully in the trial and deliberation sessions and the adjudication of all matters of reality and law raised by the criminal case, with the exception of the civil lawsuit Dependency brought before the criminal court.

On the basis of this participation between the legal members and other jurors in the court concerned with the examination of crimes, whether before the first degree or before the second degree, the question arises about the effectiveness of the jury system in terms of achieving justice, or is it harmful to it.

Hence, we try to highlight the jurisprudential debate on this issue between supporters and opponents, in order to reach an appreciation of this system after the comparison between the two views.
