Human history has witnessed the use of chemistry outputs in wars, which goes far beyond the ethic principles and humanitarian considerations.

This terrible use of chemical had encouraged jurists and politicians to call expressively for its ban, tend to the comprehensive prohibition of its production, and use in warfare.

In the last years, a new discussion is opened about the efficiency of the juridical international mechanisms to respond to the humanitarian requirements and to the world consciousness for protecting civilians and avoiding the tragedies of the chemical.

Algeria had suffered from the brutality of the French colonization that sought to use all the destructive arms like the chemical weapons.

This latter caused an extensive agony and a large environmental destruction that pushed us to study the mechanisms of the legal pursuit, the reparation for damages caused to the Algerian state and obtaining the recognition of France liability for that.
