Diplomatic immunity of international organizations' representative from prosecution in domestic jurisdictions of receiving states has always been an integral aspect of the international legal personality granted to international organizations in order for them to carry out their functions in an effective manner for the fulfillment of their pre-determined aims.

Such immunity is considered as a right protected by the principles and rules of public international law, and recognized by the United Nations (UN) as a followed practice in international relations.

However, the recent incident involving the managing director of the International Monetary Fund (IMF), Dominique Strauss-Khan, when he was arrested and charged with sexual assault and attempted rape of a housekeeper at the Sofitel hotel in New York; is worth a pause.

This article will revisit the concept of international immunity status under the scope of public international law, and its interaction with the case in question, examining, as an example, the problematic interpretation of the United States' judicial system of the Vienna Convention on the Law of Treaties when dealing with Strauss-Khan case.
