Abstract EN

This paper tackles an important issue which is the special cadres' right to appeal to courts against disciplinary decisions.

Those cadres are judges, university teaching staff members along with their assistants, members of public prosecution (attorney Generals) and members of the Central Organization for Control and Accounting.The researcher found out that the above-mentioned cadres have the right to appeal to court against any disciplinary decisions.

It wsa also found that the nature of these decisions varies from administrative decisions to law decision.

They also differ with reference to the need for a final verification from other authorities and with reference to their punishments.

The researcher recommended giving all those cadres including members of the Central Organization for Control and Accounting the right to appeal against the disciplinary decisions, the establishment of administrative courts and branch for administrative appeal and finally the researcher recommended extending the Yemeni law to monitor the suitability of the disciplinary decisions.
