Abstract EN

This study deals with the latest developments in the law of the residence of Iraqi aliens in response to the circumstances and changes that took place in Iraq after the events of 2003 and more precisely after the entry into force of the “Constitution of the Iraq” in 2005, those circumstances and changes necessitated the competent authorities to work in order to find a compatibility between them and the legislation that was in force in Iraq before these happenings.

So this research is not about any particular problem in the law of residence, but it is devoted to demonstrate the new provisions in the law in force, not only the review of the developments, but the researcher tried to explain his point of view in reviewing each new provision either by supporting the position of the law in force or not supporting it, at the discretion of the researcher, with demonstrating the reasons for supporting the position of the legislator or not supporting him.

The research has concluded a number of recommendations and suggestions that addresses the loopholes which present in the provisions of the existing law, and provided solutions that, if they take into consideration, they will lead to the avoidance of defects in the provisions of the mentioned law.
