The Litigation of political parties is an administrative litigation, subject to the general rules set out in the code of Civil and Administrative procedure.

However, it is governed by special norms adopted by organic law on political parties.

This article aims to clarify the legal regime of this litigation under organic Law No.

12-04, which will show its peculiarity, distinction from the administrative Litigation, its subordination to the system of a single degree of jurisdiction, and the hesitation of the council of state as to limits of its jurisdiction as a partisan court

Le contentieux partisan est un contentieux administratif, soumis aux règles générales consacrées par le Code de procédure civile et administrative, de plus il est régi par des normes spéciales prévues par la loi organique relative aux partis politiques.

Cet article vise à clarifier le régime juridique de ce contentieux en vertu de la loi organique n° 12-04, qui montrera sa particularité, sa distinction du contentieux administratif, sa subordination au système d'un seul degré de juridiction, et l'hésitation du Conseil d'État quant aux limites de sa compétence en tant qu'une cour partisane.
