إن مهنة الطب مهنة إنسانية تقتضي بذل العناية اللازمة التي يفرضها قانون أخلاقيات المهنة في معالجة المرضى و التخفيف من آلامهم لكن كثيرا ما نسمع اليوم عن عمليات الإجهاض التي تجرى في سرية تامة بعيدة عن أعين الناس و السلطات المختصة تكون نتائجها وخيمة قد تصل إلى حدوث الوفاة لهذا لجأت معظم القوانين و التشريعات إلى تجريم الإجهاض و عدم إباحته إلا بشروط محددة.
و من هذا المنطلق جاءت هذه الدراسة لتسلط الضوء على حدود مسؤولية الطبيب عن جريمة الإجهاض في ظل التشريعات المستحدثة
Abstract EN
The medical profession is a humanitarian one that requires a due diligence imposed by the Code of Medical Ethics dealing with the treatment of patients and pain relief.
Today, we often hear about abortion cases that take place in complete secrecy far from the eyes of the people and the competent authorities.
With this regard, the present study discusses the responsibility of the doctor in the case of an abortion crime based on the existing laws and the facts of reality.

La profession médicale est une profession humanitaire qui exige une diligence raisonnable imposée par le code de déontologie médicale quant au traitement des patients et le soulagement de leur douleur.
Aujourd’hui, nous entendons souvent parler des avortements pratiqués dans le plus grand secret, loin des yeux de la population et des autorités compétentes.
Dans cette optique, cette étude met en exergue l’étendue de la responsabilité du médecin pour le crime d’avortement entre la loi et la réalité.
