منح ميثاق الأمم المتحدة لقرارات مجلس الأمن المتخذة في إطار الفصل السابع قيمة قانونية ملزمة في مواجهة الدول الأعضاء و حتى غير الأعضاء في المنظمة لقد فسر هذا الأثر الملزم على أن قرارات مجلس الأمن مشمولة أيضا بحكم المادة 103 و التي تقرر لها أسبقية في حال التنازع مع التزامات الدول الأمر الذي يجعل مصير هذه الالتزامات محل تساءل لاسيما و أن صناعة القرارات في مجلس الأمن لا تخضع في جميع الحالات لاعتبارات المشروعية بل لتأثير الأعضاء الدائمين ما قد يحول امتياز الأسبقية إلى وسيلة لهدم النظام القانوني الدولي.

Abstract EN
The United Nations Chart has given the resolutions of the Security Council, taken under Chapter VII, binding legal force vis-à-vis of the state members.
The interpretation given to this binding effect is that Security Council resolutions are also included in the provision of Article 103 which takes precedence in the event of conflicting state obligations.
This raises the question of the fate of these commitments, especially since the drafting of resolutions within the Security Council is not, in any case, subject to considerations of legality, but to the influence of the permanent members, which could turn the priority privilege into a means to destroy the international legal order.

La charte des nations unies a octroyé, aux résolutions du Conseil de sécurité prises en vertu du chapitre VII de la valeur juridique contraignant face aux États, L’interprétation apportée à cet effet obligatoire est que les résolutions du conseil de sécurité sont incluses aussi dans la disposition de l’article 103 qui a la priorité en cas de conflit des obligations des Etats.
Cela soulève la question du sort de ces engagements, surtout que l’élaboration des résolutions au sein du conseil de sécurité n’est pas soumise, dans tous les cas, aux considérations de la légalité, mais à l’influence des membres permanents.
Ce qui pourrait transformer le privilège de priorité à un moyen pour anéantir l’ordre juridique international.
