The legislator has conferred broad discretion on the judge to investigate the imposition of criminal investigation procedures and the fact that there is a certain degree of flexibility in decision – making that circumstances require in order to suit different situations.

Thus, the investigating judge can vary the procedures according to the method of handling each case.

It can be seen though the opening or mediation statements in the Iraqi Code of Criminal procedure, Which are an indicator of that authority.

For example, the legislator does not mention in certain legal terms some expressions (may) or (for the investigating judge) or (estimated)
