Abstract EN

The intent behind legislators' inclusion of public employee's or civil servant's fault liability within public law authorities was to address many matters.

First of all, they sought to stay away from courts and the accompanying delay of proceedings at these courts, besides the big efforts and large funds.

They also intended to quickly recover the public fund and to fix the damage inflicted by the public fund, since these funds are allocated for public interest and hindrance to and delay in repairing the incurred damage shall weaken the ability of achieving its [fund] goal.

Moreover, this shall enable management to tackle corruption [which affects public fund] and protect it from fiddlers, in addition to other goals.

Therefore, in order to be aware of the mentioned subject the research has been divided into two sections.

Section One discusses the extent of fining, and Section Two discusses fining competent authority, as well as the conclusion which includes the most important conclusions and proposals.
