In many of its judgments and advisory opinions, the international judiciary has tried not only to emphasize the substantive nature of international humanitarian law but also to work towards the development of this nature and to bring it to some degree of protection and guarantees that this humanitarian law will respect all States.
Although Article 1 common to the four Geneva Conventions obliges all member states to respect these agreements, Article 2 states that if a State Party to the conflict is not a party to the Conventions, the States Parties to the conflict remain bound by them in their mutual relations.
Ensures the continued application of each of the four Geneva Conventions to all parties, even if one of the belligerents is not bound by the Convention.
Therefore, the obligations under international humanitarian law are fundamental obligations relating to the vital interests of the international community, the consequences of which are the violation of an international sanction.
