This article is a reflection about the right to be judged by the natural judge, considered as a fundamental right of the human rights.

It is about its definition as well as its historical evolution in the Algerian judicial organization since the independence.

The right to be judged by a natural judge, based on the principle of equality before justice, is considered as a fundamental right of the litigant.

It has for objective to preserve the independence of the judiciary from the intrusions of the executive power in its field through the creation of special courts.

However, nothing prevents the legislator from establishing specialized courts to know some cases
