خلافا للقواعد العامة التي تقضي باختيارية التأمين في العقود فإن المشرع الجزائري وسعيا منه لحماية الأطراف الضعيفة في عقد مقاولة بناء قرر حماية قانونية واسعة لهم بفرض إلزامية الـتأمين و هذا راجع للأهمية البالغة التي يتميز بها في مجال البناء و رتب التزامات على الأطراف المتدخلين في عملية البناء وذلك بنصوص قانونية آمرة لا يجوز الاتفاق على خلافها جراء الأخطار التي تمس المباني من تهدمات أو عيوب خطيرة فمن تخلف عن اكتتاب عقد التأمين يتعرض لعقوبات رادعة و هذا حرصا منه على جبر الأضرار التي تمس بعض الأشخاص من عملية البناء لكن يطرح التساؤل عما إذا كانت الحماية المقررة في التشريع الجزائري كفيلة بتعويض الأفراد جراء هذه العيوب و هو موضوع هذه الورقة البحثية.

Abstract EN
Contrary to the general rules for electing insurance in contracts, in an effort to protect weak parties in a construction contract, has decided on a broad legal protection for them buy imposing compulsory insurance for their ten-year responsibility, and this is due to the extreme importance that he has in the construction field, and has arranged obligations on those involved in the construction process, with peremptory legal texts undoubtedly, As a result of the dangers that affect the building and threaten its safety and durability, whoever fails to subscribe to it has decided deterrent penalties, and this is in order to ensure the reparations that affect some people from the construction process.
