تلعب الإجراءات الوقتية و التحفظية في القانون الدولي الخاص دور مهم في حماية الحقوق ذات الطابع الاستعجالي التي يصعب حمايتها عند تطبيق القواعد العادية مما يؤدي إلى فقدان الحق أو تلف الشيء المعني بالحماية.
ليست الغاية من اتخاذ هذا النوع من التدابير هو الحصول على حكم يفصل في موضوع النزاع بل هي مجرد حماية بديلة للحماية العادية الناشئة عن القضاء العادي إلا أنها لا تمس بأصل الحق فأساسها اعتبارات العدالة التي تهدف لتحقيق التعاون القضائي الدولي.
فهي عبارة عن تدابير يأمر بها القاضي تفاديا لمنع إنكار العدالة بدورها منحت تطبيقات القضاء الدولي المقارن اختصاصها على أساس ضابط تلافي إنكار العدالة خشية ضياع الحقوق خاصة في حالة عدم وجود قاضي مختص للفصل في النزاع سنحاول من خلال هذه الدراسة تسليط الضوء حول الدور التي تلعبه هذه الإجراءات في السعي لتحقيق العدالة في الخصومات ذات العنصر الأجنبي مع حماية مصالح الأفراد بغض النظر عن جنسياتهم
Abstract EN
The temporary and conservative measures in private international law aim to protect an urgent interest that difficult to protect when applying the normal rules, wich leads to loss of the right or damage to the thing concerned with protection, the regularity arising from the ordinary judiciary but it affects the principale of the right as its basis is considerations of justice and the achievement of international judicial cooperation, the weak party in the ence of competent judge to adjudicate the disput to avoid denial of justice.
Through this study we will try to shed light on the important role that these measures play in the pursuit of justice in litigations that have a foreign element, while protecting the interests of individuals, regardless of their nationalities.
