Praise be to God and the best of prayers and peace be upon the Messenger of God, our Master Muhammad, his family, companions, and those who guided his guidance until the Day of Judgment.

And after: God Almighty is grateful to His servants for guiding them to this noble religion, making in it the goodness of their condition in their world and their last, and creating in it provisions for all their conditions, and among these conditions is the silence of the commissioner and the legal rulings upon which he is based, as it is considered a presumption that indicates his satisfaction and takes the place of explicit pronunciation in many Transactions.

Silence took an abundant share of the interest of jurists and fundamentalists in the folds of their investigations and their branches, but we did not see in it what our eyes signed on it a special study that collects an original for this article and highlighting its role as a presumption in proving the legal ruling, but we found some of the books in the juristic branches that dealt with the rule of silence in it and did not address its rooting and its impact As evidence, then this research tagged (the presumption of silence and its role in proof).
