تعتبر حوادث المرور من أكثر المواضيع التي يهتم بها رجال القانون وذلك بالنظر لما تلحقه من كوارث و مآسي ناتجة عن استحالة الحصول على التعويضات المستحقة للمتضررين في بعض الأحيان خاصة إذا كان الحادث من الحوادث التي لا تشملها تغطية شركات التأمين.
و هو الأساس الذي جعل المشرع الجزائري يغير نظرته لمسألة التعويض و للمسؤولية المدنية و يقرر التدخل الاحتياطي للدولة لإنصاف الضحايا الجسمانيين وضمان حصولهم على التعويضات المقررة لهم قانونا عبر هيئة تعرف بصندوق ضمان السيارات
Abstract EN
Legal problems generated by traffic accidents have been extensively addressed by legal experts who have noted in particular the difficulties experienced by victims in obtaining compensation, especially in the event that the Insurer invokes a case of forfeiture or of exclusion.
This prompted the legislator to approach the issue of compensation and civil liability for accidents from an innovative approach by incidentally intervening by the State through the automobile guarantee fund.

Les problèmes juridiques générés par les accidents de la circulation ont été abondamment abordés par les juristes qui ont relevé en particulier les difficultés qu’éprouvent les victimes à se faire indemniser, spécialement dans le cas où l’Assureur invoque un cas de déchéance ou d’exclusion.
Cela a incité le Législateur à aborder la question de l’indemnisation et de la responsabilité civile en matière d’accident sous une approche innovante en faisant intervenir accessoirement l’Etat à travers le fonds de garantie automobile.
