The Algerian legislator, like the rest of the legislators, added and provided strict legal controls in the use of public funds, and took great care to ensure that they are used according to legitimate models, and criminalized every act that changes the direction of their use, in every way contrary to the law, and introduced several Crimes in the Prevention and Combating of Corruption Law, we mention among them the crime of embezzlement of public money in the public sector, after which it was criminalized in codifying penalties It is from this logic that the problem of the privacy of the rules of criminalization and punishment arises in this crime, without neglecting the issue of providing protective measures for the public employee in order not to violate his privacy, and this balance forms the essence of the criminal policy to protect public money from its waste through the crime of embezzlement.
