Abstract AR
يكتسي موضوع الإستثمار (الأجنبي و الداخلي) و تأثيراته و الإشكاليات التي يطرحها في إطار التنمية المستدامة أهمية بالغة في اقتصاديات الدول المتقدمة و النامية على حد السواء.
و يعتبر الإستثمار إحدى أهم الدعائم لتحقيق رؤية البحرين لخطة الأمم المتحدة لعام 2030 في تحرير السوق و تفعيل دور القطاع الخاص و تحسين القدرة التنافسية للاقتصاد و خلق مواطن شغل جديدة و فتح آفاق للأجيال الحاضرة و اللاحقة.
و الإستثمار يبقى قاصرا هشا عن تحقيق تنمية شاملة و كاملة ما لم يكن هناك مناخ حقوقي يضمن الحريات و يوفر الأمن و الإستقرار وضمان التوازن الاجتماعي و نشر العدالة بين الناس.
لذا عملت البلدان العاملة على تنفيذ خطة التنمية المستدامة لعام 2030على توفير مناخ ملائم لجلب الإستثمار من تأصيل قانوني و تشجيع و حفز المستثمرين للنفاذ إلى السوق بسهولة و وضع آليات حمائية وضمانات جبائية و جمركية و تيسير إجراءات التنازع و تبسيطها كاللجوء إلى التحكيم و الصلح كتقنية إجرائية حمائية للمستثر الأجنبي بحثا عن تنمية متناغمة سياسيا و اقتصاديا و اجتماعيا و بيئيا لخدمة الفرد و المجموعة.
سيظل التوازن مفهوما محوريا في الفلسفة التشريعية لكل الدول العاملة على تنفيذ خطة الأمم المتحدة للتنمية المستدامة لعام 2030 و سيتخذ أبعادا عديدة: فهو توازن بين الجهات و الفئات و الأجيال و ما يفتحه من آفاق للأجيال القادمة و هو توازن بين المادي و الإنساني و هو توازن بين الحقوق و الواحبات.

محوره الإنسان فهو منطلق وغاية التنمية الرامية إلى تحسين ظروف عيشه و نوعية حياته إلى الرفاه الاجتماعي.
و هذا الرفاه الاجتماعي لا يتحقق إلا بالإستثمار في المعرفة و العلم فهي أساس التنمية المستقبلية و بناء إنسان الغد على معاني الحداثة.
إن إشكالية هذا البحث تكمن في إبراز ضرورة و أهمية استقدام و جلب الاستثمارات الأجنبية وتوفير الحماية القانونية لها و تحسين مناخ الأعمال و التحفيز و التشجيع عليها.
هذا كله من أجل تحقيق الهدف الأساسي ألا و هو المساهمة في التنمية الاقتصادية في إطار تنمية شاملة و مستدامة.
Abstract EN
National and foreign investment process, its effects and the problems posed in the context of sustainable development, acquires great importance in the development of both developed and developing countries.The investment is one of the important accessories to realize the vision of the Bahrain to the plan of the United Nations for the year 2030 in the liberalization of markets, the activation of the role of the private sector, the improvement of the competitiveness of the economy, the creation of new jobs and open up new prospects for present generations and suffix.
Investment cannot achieve a general development to the existence of a climate of rights which guarantees fundamental freedoms and ensures security, stability, social balance and justice between people.
It is for this reason that countries which implement the plan of sustainable development for the year 2030 shall ensure an adequate climate to attract investment and promote investors to access the market easily, and put the mechanisms of protection and tax and customs guarantees and to facilitate and simplify the procedures of litigation such as the use of arbitration and reconciliation as a protective procedural technique to foreign investors, and this for achieve harmonious development politically, economically, socially and ecologically for the interest of the individual and the group.
The balance will remain a central concept in the philosophy of all States to implement the plan of sustainable development of the United Nations for the year 2030 and will have many dimensions: It's a balance between classes and generations, which opens prospects for future generations, and a balance between man and material, between rights and duties.
Centered on the man, who is the goal and purpose of development aimed at improving the conditions and quality of life in social welfare.
The problem with this research is to show the necessity and importance of attracting foreign investment, providing legal protection and improving the business climate and stimulating and encouraging it.
All this is in order to achieve the fundamental objective of contributing to economic development within the framework of comprehensive and sustainable development.

Le processus de l’investissement (national et étranger), ses effets et les problèmes posés dans le contexte du développement durable, acquiert une très grande importance dans le développement des pays aussi bien développés qu`en cours de développement.
L’investissement est l’un des accessoires importants pour réaliser la vision du Bahreïn au plan des Nations Unies pour l’année 2030 dans la libéralisation des marchés, l’activation du rôle du secteur privé, l’amélioration de la compétitivité de l’économie, la création de nouveaux emplois et à ouvrir des perspectives pour les générations présentes et de suffixe.
L’investissement ne peut réaliser un développement général qu’à l’existence d’un climat de droits qui garantit les libertés fondamentales et assure la sécurité, la stabilité, l’équilibre social et la justice entre les personnes.
C’est Pour cette raison que, les pays qui mettre en œuvre le plan de développement durable pour l’année 2030 veillent à assurer un climat adéquat pour attirer les investissements et promouvoir les investisseurs pour accéder au marché facilement, et à mettre des mécanismes de protection et des garanties fiscales et douanières et à faciliter et simplifier les procédures du contentieux tel que le recours à l’arbitrage et la réconciliation en tant que technique procédurale protective aux investisseurs étrangers, et ce pour réaliser un développement harmonieux politiquement ,économiquement, socialement et écologiquement pour l’intérêt de l’individu et du groupe.
L’équilibre restera un concept central dans la philosophie de tous les États pour mettre en œuvre le plan de développement durable des Nations Unies pour l’année 2030 et aura de nombreuses dimensions: c’est un équilibre entre les classes et les générations, ce qui ouvre des perspectives pour les générations futures, et un équilibre entre l’homme et le matériel, entre droits et devoirs.
Centré sur l’homme, qui est l’objectif et le but du développement visant à améliorer les conditions et la qualité de sa vie au bien-être social.
Et cette protection sociale ne sera possible qu’en investissant dans la connaissance et la science qui est à la base du développement futur et de la construction de l’homme de demain sur les bases de la modernité.
