To protect the rights and liberties of individuals who are constitutionally guaranteed The Algerian constitutional institution adopted the mechanism of non-constitutional reform, following the constitutional amendment of 2016, in particular Article 188 thereof, and this is a guarantee to enable individuals to exercise their right to enforce laws that violate their rights and freedoms As in the case of other comparative legislation in this area, most notably French legislation.

The organization of this matter referred to the Organic Law, which was delayed until September 2018, following Organic Law 18/16, which defined the terms and conditions of the payment of unconstitutionality, and in order to control all matters related to the process and avoid the practical problems resulting from it, Despite the fact that this legal text has not been delivered from some of the criticisms against it in particular, in view of the many shortcomings that have afflicted it.
