The mediation is a new type of penal procedures used to end disputes of a penal nature, and an alternative mechanism for penal follow-up, dedicated by the Algerian legislator for cases of penal nature in 2015 under Order No.

15-02 of 23 July 2015 amending and supplementing the Code of penal procedures for the adult complainer, and by act No.

15-12 of 15 July 2015 on the protection of the child for the complainant, including juveniles.

The problem raised by the subject of this study concerns the examination of the effectiveness of the procedural rules and the conditions laid down by the Algerian legislator for the application of the penal mediation system in achieving its objectives? In this study, the conditions of application of penal mediation in the Algerian law and its procedures were discussed, and also the implications of the mediation procedure.
