Abstract EN

This paper deals with one of the alternative penalties for the short term freedom penalty adopted by the Algerian legislator after the amendment of the Penal Code through Articles 5 bis 1 to 5 bis 6, which is the penalty for public benefit.

There is no doubt that the Algerian legislator aims to include the punishment of the public interest to achieve many purposes, the most important of which is to spare the convict the disadvantages of short-term imprisonment, and try to rationalize penal policy in the style of comparative legislation.

Cet article traite de l'une des peines de substitution pour la peine de liberté à court terme adoptée par le législateur algérien après la modification du Code pénal par les articles 5 bis 1 à 5 bis 6, qui constituent une peine d'intérêt public.

Il ne fait aucun doute que le à des fins multiples, dont le plus important est d'épargner au condamné les inconvénients de la détention à court terme et d'essayer de rationaliser la politique pénale de la même manière que la législation comparée.
