Abstract EN

This research deals with the study and analysis of two important crimes of international crimes, namely genocide and war crimes, where we seek to clarify and clarify the international legal nature of each crime by determining what they are, so the crime of genocide is achieved when attacking one of the groups covered by international protection and immunity such as racial, ethnic, religious groups Nationalism, while war crimes occur when a country violates internationally recognized rules, laws and customs of war and codified in the relevant international agreements.

This study revolves around researching the general legal theory of the crime of genocide and war crimes by examining the definitions given to them at the international legal level through the agreements organizing the two crimes, then the constituent elements of them, nd the criteria that distinguish them from each other, all in order to remove all interference or Ambiguity may arise around them, through relying on the legal methodology based on the descriptive and analytical approaches, to reach scientifically acceptable legal results.
