Abstract EN

If the partner is a foreigner, the dissolution of marriage could raise several problems in the field of private international law.

Amongst such problems is the one related to the confusion caused in determining the applicable law.

Thereby, in order to overcome this problem, legislations, including the Algerian legislator, have sought reliable attribution rules to determine the relevant law.

The latter is one of the competing laws governing the legal relationship.

In this respect, legislations attempt to protect their citizens given that the relevant law may be foreign.

Hence, they implement the exceptional application of the judge's law in case a link between the conflict and the state of the judge is established.
