Abstract EN

This study aims to clarify the psychological punishments concept's reality and the scope of their application in the Algerian legislative texts.

The study found that psychological punishments inflict a profound psychological pain to the sentenced person, and that the Algerian legislator's way of dealing with the psychological punishments is still wanting in terms of concept and application, where it confuses both of them with the disciplinary punishments.

In addition, from the legal point of view, the publication of the judgment, which falls within the notion of defamation of the misdemeanor committed by the accused through announcing his/her crime, is a type of psychological punishment.

This is because the latter has a great impact on his/her psyche and contributes to deterring him/her from corruption and criminality, especially if s/he has a great sense of pride and fears the scandal in front of people.
