إن الطابع السلطوي لهيئات الضبط المستقلة جعلها تمارس امتيازات السلطة العامة أن القرارات التي تتخذها سلطات الضبط يمكن أن تشوبها عيوب يقتضي تفعيل مبدأ الرقابة القضائية و لكي تتمكن هذه هيئات من أداء دورها تحتاج إلى محيط قانوني مستقر في حل النزاع و الإجراءات المتخذة ضدها في حال ما إذا كانت طرفا فيه
Abstract EN
The authoritarian nature of independent control bodies has made them exercise the prerogatives of public authority.
The decisions taken by the control authorities may have flaws.
It is necessary to activate the principle of judicial oversight, and for these bodies to be able to perform their role, they need a stable legal environment, in resolving the dispute and the measures taken against them in the event that She was a party.
