Abstract EN

The research aims at liberating the concept of "Fiqh of Minorities'', in line with the real changes, as a consideration for Shari'a, and adherence to the juristic sense.

And the importance of concepts in the legitimate perspective of the underlying judgments; and because the concept of 'jurisprudence of minorities" still needs to be edited and articulated.

And follow the most important problems that apply in the statement of the concept, including the exclusive meaning (numerical) of the minorities in the concept, without regard to the moral meaning is (vulnerability), which was accompanied by the Holy Quran As well as to make the minorities are groups living outside the homes of Muslims, the difficulty of identifying the homes of Muslims, and any standards in this, as well as the problematic evocation of the word (Dar al- Harb) and oflset (Dar Islam) and Astnjad provisions of those homes according to the old jurisprudential perspective.

The research sought to address this by discussing the contemporary definitions of the concept, and giving meaning (to the jurispnidential doctrine) With emphasis on the tenn "vulnerability" as the most influential part of Shari'a governance rather than the number, and the observation of realistic considerations and changes in the change of provisions, as well as the observance of their mandates.
