يهدف هذا المقال إلى دراسة مدى فعالية التنظيم القانوني لجرائم البناء و التعمير في ظل القانون رقم 90-29 المتعلق بالتهيئة و التعمير المعدل و المتمم مع الاستعانة ببعض النصوص الأخرى ذات الصلة و منها المرسوم التنفيذي 06-55 المؤرخ في 30/12/2006 وذلك وفق أسلوب وصفي تحليلي وقد تم التوصل إلى أن المشرع الجزائري لم يعالج كل جرائم البناء و التعمير المتعارف عليها و هذا ما يطرح بدوره عدة إشكالات في مجال مكافحة هذه الجرائم و هو ما يستدعي تعديل هذا القانون أو استحداث قانون جديد في مجال التعمير و البناء يحقق هذا المسعى

This article aims to study the effectiveness of legal regulation of construction and reconstruction crimes under Law No.
90-29 related to layout and reconstruction amended and supplemented, With the help of some other relevant texts, including Executive Decree 06-55 of 12/30/2006, according to a descriptive and analytical method, it has been concluded that the Algerian legislature did not address all recognized construction and reconstruction crimes, and this in turn raises several problems The field of combating these crimes, which requires amending this law or introducing a new law in the field of construction and reconstruction, that accomplishes this endeavor.
