Traditional guarantees can no longer cover the risks faced by the bank, hence the introduction of modern guarantees including the use of the right of ownership to meet the value of the loan.

However, is the bank's retention of ownership an effective guarantee against loan risks? In this study, we follow the descriptive and analytical approach, aiming to highlight the new role of ownership in the loan contract taking the form of bank financing of it until the payment of all due installments, as it is one of the most powerful modern guarantees adopted in several loans such as Islamic banking.
