يتطلب تعزيز مقتضيات الأمنين القانوني و القضائي في جزائر ما بعد الاستعمار تحديات كبرى و لعل نمذجة نظام قانوني توافقي أهم هذه التحديات أمام أزمة المرجعية القانونية التي خلقتها التحولات المعيارية المتعارضة مع الموروث القانوني الاستعماري و التي استلزمت استحضار كل مصادر القانون المتعددة ذات الفعالية الضبطية خاصة التقليدية منها التي احتكم إليها المجتمع الجزائري في مراحل معينة من تاريخه و إدخالها في المنظومة المعيارية الحديثة.
لكن اعتماد الذكاء القانوني من شأنه تذليل هذه الأزمة من خلال تركيب أفقي للمصادر القانونية المكونة للنظام القانوني الجزائري لاسيما الشريعة و العرف أو بتقنينها بهدف تشكيل كل متجانس يهدف لتكريس الأمن القانوني.
Abstract EN
Strengthening legal and judicial security requirements in a post-colonial Algeria calls for significant challenges.
in fact, the syncretic modeling legal system would be the most urgent challenge to face, notably in view of the legal referential crisis due to the regulatory changes that do not always reflect the colonial legal heritage, thus requiring the involvement and integration into the modern regulatory system of all legal resources with regulatory efficiency, and particularly, traditional resources, which the Algerian society has invoked throughout the course of its history.
Nevertheless, the adoption of legal intelligence would be able to soften this crisis, if it would favor a horizontal consolidation of the legal systems constituting the Algerian legal system, namely the sharia and custom, as well as their codification, in the perspective of shaping a homogeneous entity intended for the consecration of legal security.

Le renforcement des exigences sécuritaires d'ordre juridique et judiciaire dans une Algérie postcoloniale implique de nouveaux défis majeurs.
En effet, la modélisation d'un système juridique syncrétique serait le défi le plus urgent à apprivoiser, notamment face à la crise du référentiel juridique dû aux mutations normatives n'allant pas toujours dans le sens de l'héritage juridique colonial, qui a nécessité l'invocation et l'intégration dans le système normatif moderne, de toutes sources à efficacité régulatrice, relatives au droit, en particulier, aux sources traditionnelles, auxquelles la société algérienne s'est identifiée à certaines étapes de son histoire.
Cependant, l'adoption de l'intelligence juridique serait à même d'atténuer cette crise, si celle-ci favorisait un assemblage horizontal des sources juridiques constituent le système algérien, notamment la charia et la coutume, ainsi que leur codification, dans l'optique de former un ensemble homogène visant à la consécration de la sécurité juridique.
