Abstract EN

: The Algerian legislator has obliged the nominated candidate to spend a probationary period, as an employee on probation, during which he is assessed continuously and periodically according to objective criteria to judge his professional competence to remain in function.

And after the expiration of this period, depending on the situation, either he is appointed, or his probation is extended, or he is dismissed without prior notice or compensation.

Considering the gravity of dismissal due to lack of professional competence, as it is one of the cases of termination states of the employee on probation, and in order to distinguish it from disciplinary dismissal, we have tried through this study to define the concept of this form of dismissal, and clarify the standards related to it that are specified in the Algerian legislation, which are considered important guarantees to protect the employee on probation.
