To protect workers from any abuse or discrimination by the employer in the payment of wages, Law 90-11 on Labor Relations established a general guarantee which must be respected by the employer, which is equal pay for workers, and this equality will be achieved only if it includes all elements of wages.

Equality must also cover all different categories of workers within a single enterprise.

Due to the difficulty of verifying the extent to which employers respect the equal remuneration of workers, the legislator has adopted a set of legal guarantees of the Constitution and the law, as well as substantive guarantees of the Labor Inspectorate and the judiciary.
